How to shop

Our online store is designed for purchases made from the Iberian peninsula and the Balearic Islands. Beyond this area, you can contact us by email us at karicia@karicia.com to place an order.

 

Buying products is easy: all you have to do is select the articles you wish to add to your shopping basket and then follow the checkout instructions.

 

The user can browse the different pages of the website without having to register. When he/she wishes to make a purchase, he/she must register in order to complete the process. He/she must then provide his/her personal details, telephone, email address, ID and shipping details, and accept the terms of purchase and privacy.

 

On placing the order, the customer acknowledges and declares that he/she has read and accepts all the terms and conditions of sale indicated on the page.

 

The customer will receive an order confirmation email. This document will be considered a contract for the purposes of the provisions of Article 23 of Act 34/2002 and the parties accept that the contract has been concluded at the registered office of the company.

 

PRIVACY

In accordance with the provisions of Article 5 of Organic Law 15/1999, we inform you that the data collected in these forms will be included in the data files of BINDU 2013 S.L. The information is collected in order to manage your purchase from our online store and to perform any other commercial activity.

 

When a customer registers, he/she authorises BINDU 2013 S.L. to use this information for commercial purposes, such as to send the brands newsletters and promotions. The customer may, however, unsubscribe at any time.

 

Under no circumstances will BINDU 2013 S.L. disclose this information to third parties.

 

PRODUCTS

The showcase of products presented by BINDU 2013 S.L. in the different sections of its website may be changed in any way, both in terms of characteristics and price, or discontinued without prior notice. In all events, the terms of sale valid at the time of purchase will remain valid.

 

There is a page on each product, specifying its characteristics, directions for use, chief ingredients and any other information which we consider to be of interest.

 

All the products shown on the website are in stock. Otherwise, a note will be published on the product page indicating that a certain product is out of stock and providing the date on which it will probably be available again.

PAYMENT METHODS

You can pay for your order by:

  • Credit card: We guarantee an easy, secure method of payment. We accept VISA and Maestro.
  • PayPal.
  • By bank transfer to BINDU 2013, S.L.; to the account emailed to you when you have placed your order. The transfer must be made within a maximum period of 3 business days from order confirmation. After this period of time, the order will be cancelled.

Orders received before 12 midday are processed on the same day. Orders received after this time are processed the next day.

 

RETURNS

Returns are only accepted in the following cases:

  • Error in the shipment.
  • Product defect.

 

To return products, proceed as follows:

  • Email us within 48 hours of receiving your order at karicia@karicia.com, indicating that you wish to return the products and why.
  • We will inform the carrier to collect the product, which must be suitably packed for shipment.
  • We will change the product for another one in perfect condition or refund you using the same method of payment used to pay for the order.
  • No claims or returns will be accepted beyond the period indicated above.
  • Under no circumstances will we accept returns due to errors made when placing the order, because we understand that the purchaser verifies and accepts the products on making the purchase.

This document (and any other document mentioned here). Regulates the terms which govern the use of the Website www.karicia.es and the purchase or acquisition of products and/or services on it (hereinafter Terms).

For the purpose of these Terms, the activity which BINDU 2013, S.L. conducts via its Website consists of: the online sale of products by BINDU, S.L., 2013 to users

Prior to accessing, browsing or using this Website and in addition to reading these Terms, the User must also read the Legal Notice and General Terms of Use, including the cookies policy and BINDU 2013, S.L.s privacy and data protection policies. By using this Website and making and/or requesting the purchase of a product and/or service through it, the User agrees to be bound by these Terms and all of the above. So if you do not agree with all these Terms, you should not use this Website.

You are also informed that these Terms may be modified. It is the Users responsibility to consult them each time he/she accesses, browses and/or uses the Website, because the Terms in force when he/she orders products and/or services will be applicable.

2.-THE USER

Accessing, browsing and/or using this Website confers the status of User (hereinafter interchangeably referred to individually as User or collectively as Users) on the party involved, meaning that as soon as you start browsing the Website, you automatically accept all the Terms established herein and any subsequent modifications to them, without prejudice to the application of relevant current legislation as appropriate.

The user assumes responsibility for the correct use of the Website. This responsibility extends to:

  • Using this Website only for legally valid consultations and purchases/acquisitions.
  • Not making any false or fraudulent purchases. If there is good reason to believe that such a purchase has been made, it may be cancelled and the relevant authorities informed.

The User declares that he/she is over 18 years of age and has the legal capacity to enter into contracts through this Website.

The Website is intended primarily for Users residing in Spain.  BINDU 2013, S.L. provides no guarantee that the Website will comply with the legislation of other countries, either totally or partially.  BINDU 2013, S.L. accepts no liability which may arise from such access, and cannot assure shipments or provisions of services outside Spain.

The User may conclude the contract for the sale of the desired products and/or services with BINDU 2013, S.L. in the language of his/her choice, selecting from those in which these Terms are available on this Website.

The User will then receive an email confirming that BINDU 2013, S.L. has received his/her order or application for purchase and/or service, i.e. order confirmation. If applicable, the User will also be informed by email when his/her purchase is sent.

Once the purchase procedure is concluded, the User agrees that the Website may create an electronic invoice to be emailed to him/her. The User may also, if he/she so wishes, obtain a hard copy of his/her invoice, requesting one from BINDU 2013, S.L. using the contact functions on the Website or the contact information provided above.

On making a purchase, the User acknowledges that he/she is aware of certain specific terms of sale concerning the product and/or service in question shown together with the presentation or, if appropriate, image of the product/service on the webpage, indicating, depending on each case, information which may include but is not limited to: name, price, components, weight, quantity, colour, product details or characteristics, how they will be carried out and/or cost of the provisions; and acknowledges that by placing the purchase or acquisition order, he/she is fully and completely accepting the specific terms of sale applicable in each case.

4.- AVAILABILITY

The prices shown on the Website are final, in Euros (€) and include taxes, unless otherwise indicated and applied due to legal requirements, particularly regarding VAT.

Shipping costs are included in the final prices of the products as shown on the Website. BINDU 2013, S.L. ships and delivers through a carrier service.

Under no circumstances will the Website automatically add additional costs to the price of a product or service; only those which the User has selected and chosen freely and voluntarily.

Prices may change at any time, but such changes will not affect orders or purchases for which the User has already received order confirmation.

BINDU 2013, S.L. uses every means to guarantee the confidentiality and security of the payment data transmitted by the User during transactions made via the Website. The Website uses a secure payment system: Redsys Servicios de Procesamiento S.L.

When BINDU 2013, S.L. receives a purchase order from the User through the Website, it requests pre-authorisation on the relevant card to ensure that there are sufficient funds to complete the transaction.  The card is charged when the User is sent confirmation of shipping and/or service provided in the form and, where appropriate, place established.

In all events, by clicking CONTINUE TO NEXT STEP, the User confirms that the means of payment used is his/her own or, if appropriate, that he/she is the legitimate owner of the gift card or voucher.

6. DELIVERY (OBLIGATIONS OF THE PURCHASER AND SELLER)

When it proceeds to physically deliver goods, deliveries will be made within the following area: Spain (Mainland and Balearic Islands).

Except for those cases in which there prevail unforeseen or extraordinary circumstances or, as the case may be, circumstances arising from the personalisation of the products, the purchase order consisting of the products listed in each purchase confirmation will be delivered within the period indicated on the Website by the shipping method selected by the User and, in all events, within a maximum period of 30 calendar days from the order confirmation date.

If for any reason, BINDU 2013, S.L. cannot comply with the delivery date, it will contact the User to inform him/her of the fact, allowing him/her to choose whether he/she would prefer to proceed with the purchase with a new delivery date or cancel the order and have the full price paid refunded. In all events, home deliveries are made on business days.

If it is impossible to deliver the order because the User is not in, it may be returned to the carriers warehouse. If this occurs, however, the carrier will leave a note explaining where the order is and what to do to have it delivered.

If the User is not going to be at the delivery address at the agreed time, he/she must contact BINDU 2013, S.L. to arrange delivery another day.

In the event that 30 days have passed since your order was first available for delivery and has not been delivered for causes not attributable to it,  BINDU 2013, S.L. will understand that you wish to withdraw from the contract and it will be deemed terminated. As a consequence of the termination of the contract, all payments received from the User will be returned, except for the additional expenses resulting from the Users own choice of delivery method other than the least costly form of ordinary delivery offered on the Website, without undue delay and, in all events, within a maximum period of 14 days from the date on which the contract is deemed to have been terminated.

However, the User must bear in mind that the need to reship as a result of termination of the contract may involve an additional cost which may be passed on to him/her.

For the purposes of these Terms, delivery has been made or the order has been delivered when the User or a third party indicated by the User gains material possession of the products, as accredited by signing the order receipt at the agreed delivery address.

The risks that the products entail are transferred to the User from the moment of delivery.  The User acquires ownership of the products when BINDU 2013, S.L. receives full payment of all the amounts due related to the purchase or acquisition made, including shipping costs, or at the time of delivery if this takes place after full receipt of the amount to be paid by the User.

In accordance with the provisions of Act 37/1992, of 28 December, on Value Added Tax (VAT), purchase orders for delivery and/or provision shall be deemed to be within the territory in which Spanish VAT is applicable if the delivery address is in Spanish territory, except the Canary Islands, Ceuta and Melilla. The VAT rate applicable depending on the item in question will be the legally valid rate at all given times.

 

7.- TECHNICAL MEASURES TO CORRECT ERRORS

The User is informed that if he/she detects that an error has been made entering the details required to process his/her purchase request on the Website, he/she can modify these by contacting BINDU 2013, S.L. using the contact functions enabled on the Website, those enabled to contact the customer service and/or the contact details provided in clause 1 (General Information)

In all events, before clicking CONTINUE TO NEXT STEP, the User has access to the shopping basket or cart space in which his her purchase requests are listed and can make modifications.

Likewise, the User is referred to the Legal Notice and General Terms of Use to obtain more information on how to exercise his/her right to rectify his/her data in accordance with Organic Law 15/1999, of 13 December, on Personal Data Protection.

 

8. RETURNS

When the User acquires products on or through the owners Website, he/she acquires a number of rights:

  • Right of Withdrawal

When the User makes a purchase on the Website, he/she, as consumer and user, has the right to withdraw from it within 14 calendar days without having to justify his/her withdrawal.

The withdrawal period expires in 14 calendar days from the day on which the User or a third party authorised by the User, other than the carrier, gains material possession of the goods purchased on the BINDU 2013, S.L. Website or, if the goods which make up the order are delivered separately, in 14 calendar days from the day on which the User or a third party authorised by the User, other than the carrier, gains material possession of the last of the goods which make up the same purchase order.

In order to exercise this right of withdrawal, the User must inform BINDU 2013, S.L. as to his/her decision. This may be done via the contact functions enabled on the Website, by emailing tienda@karicia.es or ringing ++974 413 341.

Regardless of the channel through which the User chooses to communicate his/her decision, he/she must clearly and unequivocally state that he/she wishes to withdraw from the purchase contract. The User may use the withdrawal form that BINDU 2013, S.L. makes available in the appendices to these Terms. Its use, however, is not mandatory.

In order to comply with the withdrawal period, simply communicate your wish to exercise your right to withdrawal before the end of the withdrawal period.

In the event of withdrawal, BINDU 2013, S.L. will refund all the payments received, including shipping costs (except for the additional expenses chosen by the User for a delivery method other than the least costly form of delivery offered on the Website), without undue delay and, in all events, within a maximum period of 14 days from the date on which BINDU 2013, S.L. is informed as to the Users decision to withdraw.

BINDU 2013, S.L. will refund the User using the same method of payment that he/she used to carry out the initial purchase transaction. This refund will not generate any additional charge to the User. However, BINDU 2013, S.L. may retain the refund until it has received the products or articles purchased, or until the User submits proof of their return, whichever comes met first.

The User must do this without undue delay and, in all events, no later than 14 calendar days after the date on which BINDU 2013, S.L. was informed of his/her decision to withdraw.

The User acknowledges that he/she must cover the direct cost of returning (shipping, delivery) the goods, if any. He/she is also responsible for any decrease in the value of the products resulting from handling, other than that necessary in order to establish the nature, characteristics and good operation of the goods.

The User acknowledges that there are exceptions to the right of withdrawal, as set forth in Article 68 of Legislative Royal Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users, and other complementary laws. Such exceptions include, but are not limited to: personalised products; products which may deteriorate or expire quickly (range of cosmetic products) without their packaging with the factory seal: products which, for health and safety reasons, are sealed and whose seal has been broken following delivery.

The same principle governs the provision of any service which the User may contract on this Website, as the same Law establishes that the User does not have the right to withdraw when the service has been fully provided or when it has started with the express consent of the consumer and user, and with his/her acknowledgment that he/she is aware that, once the contract has been fully executed by BINDU 2013, S.L., he/she will have lost his/her right to withdraw.

In all events, no refund will be made if the product has been used beyond merely opening it, if the product is not in the same condition as that in which it was delivered or if the product has suffered damage after delivery.

Likewise, the products must be returned using or including all the original packaging, instructions and other documents which accompany them, together with a copy of the purchase invoice.

 

  • Return of defective products or shipping error.

These are all cases in which the User considers that, at the time of delivery, the product does not conform to the stipulations in the contract or purchase order. In this event, he/she must contact BINDU 2013, S.L. immediately and inform it as to the disconformity (defect/error) by the same means or using the contact details provided in the previous section (Right of Withdrawal).

The User will then be informed on how to proceed in order to return the products and these, once returned, will be examined and he/she will be informed, within a reasonable period of time, if he/she is entitled to a refund or, where appropriate, replacement of the product.

The amount paid for products which are returned due to defects, when these really exist, will be refunded in full, including the cost of delivery and any other costs which the User may have incurred in order to return them. The amount will be refunded by the same payment method that the User used to pay for the purchase.

In all events, the Users rights, as user and consumer, as recognised in current legislation will always prevail.

  • Warranties

As consumer and user, the User is protected by warranties on products that he/she may purchase through this Website, in the terms legally established for each type of product. Consequently, BINDU 2013, S.L. is liable for any lack of conformity of the product which may manifest itself within a period of two years from delivery.

For this purpose, products are in conformity with the contract when: they conform to BINDU 2013, S.L.'s description and possess the characteristics presented therein; they are suitable for the uses ordinarily intended for products of the same type; and they are of a quality and perform in a way considered usual for and fundamentally expected of a product of the same type. When this is not the case with respect to the products delivered to the User, the User should proceed as described in the section Return of defective products or shipping error. Nevertheless, some of the products sold on the Website may present non-homogenous characteristics as a result of the type of material from which they are made and which, therefore, form part of the individual appearance of the product; this is not considered to be a defect.

The User may also acquire on the Website a product belonging to a brand other than the owner of the Websites own brand or one manufactured by a third party. In this case, if the User considers that the product is defective, he/she may also contact the brand or manufacturer responsible for the product to find out how to claim against the legal warranty in the two years following delivery of the products. In order to do this, the User must have kept all the information regarding the warranty of the products.

 

9.- EXEMPTION FROM LIABILITY

Unless legal provisions state the contrary, BINDU 2013, S.L. will not accept any liability for the following losses, regardless of their origin:

  • Losses which cannot be attributed to any type of breach on its part.
  • Business losses (including loss of profit, income, contracts, expected savings, data and goodwill, and unnecessary expenses incurred), or losses of BINDU 2013, S.L.
  • Any other indirect loss which was not reasonably foreseeable by the parties when the contract between the parties for the sale of the products was concluded.

Similarly, BINDU 2013, S.L. also limits its liability in the following cases:

  • BINDU 2013, S.L. will act with the greatest diligence to make the product ordered available to the company responsible for transporting it. However, it accepts no liability for any damage caused by the transport not functioning properly, especially for reasons such as strikes, congestion on roads and, in general, any other cause inherent to the sector, resulting in the delay, loss or theft of the product.
  • Technical failures which, due to fortuitous or other causes, prevent normal operation of the online service. Unavailability of the Website for maintenance or other reasons, meaning that the service is unavailable. BINDU 2013, S.L. places all the means at your disposal in order to purchase and pay for the products, and have them shipped/delivered. However, it accepts no liability for causes which are not attributable to it, unforeseeable circumstances or force majeure.
  • BINDU 2013, S.L. accepts no liability for the misuse and/or wear of products which have been used by the User. Likewise, BINDU 2013, S.L. accepts no liability for products erroneously returned by the User. It is the responsibility of the User to return the correct product.
  • In general, BINDU 2013, S.L. will accept no liability for any breach or delay in the performance of any of the obligations assumed when the breach or delay is due to events which are beyond its reasonable control, i.e. cases of force majeure, which may include, but are not limited to:
    • Strikes, lockouts or other industrial action.
    • Civil unrest, riots, invasions, terrorist threats or attacks, wars (whether declared or not), or threats of or preparations for war.
    • Fires, explosions, storms, floods, earthquakes, subsidence, epidemics or any other natural disaster.
    • Inability to use trains, ships, aeroplanes, motor transport or other means of transport, public or private.
    • Inability to use public or private telecommunications systems.
    • Acts, decrees, legislation, regulations or restrictions on the part of any government or public authority.

In such cases, BINDU 2013, S.L.s obligations will be suspended for the length of time during which the cause of force majeure continues and it will be awarded an extension on the time available to it to fulfil them equal to the duration of the cause of force majeure. BINDU 2013, S.L. will make every reasonable effort to find a solution which will allow it to fulfil its obligations despite the cause of force majeure.

 

10.- WRITTEN COMMUNICATIONS AND NOTIFICATIONS

By using this Website, the User accepts that most of the communications between him/her and BINDU 2013, S.L. will be electronic (e-mail or notices posted on the Website)

For contractual purposes, the User agrees to use these electronic means of communication and acknowledges that all contracts, notifications, information and other communications which BINDU 2013, S.L. may send electronically comply with the same legal requirements as their paper equivalents. This term does not affect the Users recognised legal rights.

The User may send notifications and/or communicate with BINDU 2013, S.L. using the contact details provided in these Terms and, if applicable, through the contact functions enabled on the Website.

Likewise, unless otherwise stated, BINDU 2013, S.L. may contact and/or notify the User via their email or the postal address provided.

 

11. WAIVER

No waiver by BINDU 2013, S.L. of these Terms or any specific right or legal action derived from a contract will take effect unless expressly stated to be a waiver and formalised and communicated to the User in writing.

 

12.- APPLICABLE LEGISLATION

These terms are expressly subject to the provisions of Act 34/2002 of 11 July, on Information Society Services and Electronic Commerce, Royal Legislative Decree 1/2007, of 16 November, approving the Consumers and Users Act, Royal Decree 1906/1999, of 17 December, regulating Telephone and Electronic Purchases with general terms, Act 7/1998 ,of 13 April, on General Terms of Purchase, Act 7/1996, of 15 January, on Retail Trade, Organic Law 15/1999, of 13 December, on Personal Data Protection and other legislation of a general nature or subsidiary application in accordance with the basic principles of the Spanish legal system.

Without prejudice to the foregoing and the application by default of Spanish national legislation, insofar as BINDU 2013, S.L. is not an information society provider which aims its services at any State other than Spain, in accordance with provisions of the Directive and only in those cases in which it is mandatory, BINDU 2013, S.L. will apply those specific conditions which may be applicable in the country of residence of the final consumer.

 

13. ENTIRE AGREEMENT

These Terms and any document expressly referred to herein constitute the entire agreement between the User and BINDU 2013, S.L. regarding the sale and replace any other previous pact, agreement or promise agreed on verbally or in writing by the parties.

The User and BINDU 2013, S.L. acknowledge that they have agreed to conclude a contract without relying on any statement or promise made by the other party, except those expressly described in these Terms.

 

14 - DATA PROTECTION

The personal information or data which the User gives BINDU 2013, S.L. in the course of a transaction on the Website will be treated in accordance with its data protection policies (Legal Notice and General Terms of Use). By accessing, browsing and/or using the Website, the User agrees that his/her information and data may be processed, and declares that all the information or data provided is accurate.

 

15.- APPLICABLE LAW AND JURISDICTION

These Terms of Purchase are governed by Spanish law. In order to settle conflicts, the parties submit, at their own will, to the courts and tribunals of the User's registered address, renouncing any other jurisdiction.

In order to submit claims regarding the use of our services, the customer can write to the email address or postal address indicated at the bottom of the page, undertaking to seek, at all times, an amicable settlement to the conflict.

 

16.- COMPLAINTS AND CLAIMS

The User can send BINDU 2013, S.L. any complaints, claims or any other comments that he/she may wish to make using the contact details provided at the beginning of these Terms (General Information).

BINDU 2013, S.L. makes official complaint forms available to consumers and users, which they can request at any time using the contact details provided at the beginning of these Terms (General Information).

Likewise, should any dispute arise as a result of this purchase agreement between BINDU 2013, S.L. and the User, the User, as a consumer, may request an extrajudicial settlement of conflicts in accordance with EU Regulation No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC.
